It often creates great stress for adults and children . Savings depleted, children alienated from one parent and/or traumatized by the entire process, both parties exhausted, children doing worse in school and behaving badly. Litigation - the usual way to obtain a divorce - only increases the stress and expense.
Since the early 1990's Caryn S. Espo has looked for alternatives to the hostile, expensive litigated divorce. Choosing a process that minimizes the trauma and increases communication leads to better solutions and easier transitions to the new family arrangements. As an attorney, I discuss alternative methods of resolving disputes so that each client finds the process best suited for his or her situation.
As a mediator I sit with the parties together to work out the issues between them. My goal is to help them find the right solutions for their own families. As a mediator I listen to the needs and desires of both parties and help them communicate so they can work through the decisions with as much information and support as they need. My goal is that both parties will feel that the process was fair, the resulting agreements are fair, and that they both acted in a manner consistent with their values.
Each party is present with his or her collaborative attorney . Collaborative attorneys do not go to court but are trained to work with their clients and colleagues in a settlement model. As a collaborative lawyer I assist my clients who choose this process through the negotiations. The goal in collaborative law, like mediation, is that the clients feel they went through their divorce fairly and with dignity.
